This License governs your use of the digital files we make available through Baud Runner (the "Site"), a storefront operated by Defensible Logic, Inc. ("we", "us", "our"). It applies to all digital downloads, including 3D-printable model files (STL files) and similar digital goods, and it applies to both free and paid files. By downloading, accessing, or using any digital file from the Site, you agree to this License. This License is part of, and incorporates by reference, our Terms of Service.

1. Files are licensed, not sold

When you obtain a digital file from the Site, you are granted a license to use that file. You do not buy or otherwise acquire ownership of the file, the underlying design, or any intellectual property rights in it. This is true whether you paid for the file or claimed it free of charge.

2. License grant

Subject to your compliance with this License, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the file for your own personal, non-commercial use. This license is personal to you and to the account through which the file was obtained.

Digital files are delivered as secure, tokenized download links. Each download grant has a finite number of permitted downloads and may expire, and links may be revoked as described in Section 6. Maintaining access to a file is not a guarantee of perpetual availability.

3. Restrictions

Except as expressly permitted by this License, you may not:

• redistribute, reshare, publish, upload, or otherwise make the file available to any third party, whether for free or for a fee;
• resell, sublicense, rent, lease, or otherwise transfer the file itself or your license to it;
• claim the design or the file as your own, or remove, alter, or obscure any attribution, watermark, or notice of ownership;
• use the file in any way that infringes our rights or the rights of our licensors, or that violates applicable law.

You may print, machine, or otherwise manufacture physical objects from the file for your own use. Resale or commercial distribution of physical objects produced from the file is not permitted without a separate commercial license, which you can request from legal@defensiblelogic.com.

4. AS-IS; no warranty; assumption of risk; waiver

This section applies to every digital file you obtain from the Site, whether free or paid. Some files are offered free of charge under this waive-all-liability license; the same AS-IS, no-warranty, and liability-waiver posture set out below applies equally to paid files.

Files are provided "AS IS", without warranty of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

By downloading or using a file, you accept all risk arising from your use of it, including without limitation the printing, machining, assembly, and operation of any resulting object. You are solely responsible for verifying the file's fitness and safety for your intended use. To the maximum extent permitted by law, you waive and release Defensible Logic, Inc. from all liability arising out of or relating to your use of the file or any object made from it.

5. Intellectual property

All intellectual property rights in and to the files, designs, and related materials remain the property of Defensible Logic, Inc. or its licensors. Nothing in this License transfers any such rights to you. All rights not expressly granted to you in this License are reserved.

6. Termination and revocation

This License and your download access may be terminated or revoked if you breach this License, or in connection with a refund, chargeback, or payment dispute relating to the file. We may revoke active download links and disable further downloads in any of these circumstances. Upon termination, the license granted to you ends, and you must stop using and, where applicable, delete copies of the file. The restrictions in Section 3, the AS-IS, no-warranty, assumption-of-risk, and waiver provisions in Section 4, and the intellectual property provisions in Section 5 survive termination. Refunds for digital downloads are addressed in our Refunds & Returns policy.

7. Governing law

This License is governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and any dispute will be resolved as described in our Terms of Service.
